A BILL to amend article nine-a, chapter eighteen of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
three-c, relating to the amount of the total basic foundation
program for public school support for the fiscal year
commencing in two thousand three.
Be it enacted by the Legislature of West Virginia:
That article nine-a, chapter eighteen of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
three-c, to read as follows:
ARTICLE 9A. PUBLIC SCHOOL SUPPORT.
§18-9A-3c. Total state basic foundation program and
foundation allowance for regional educational service agencies for the fiscal year commencing two thousand
three.
Notwithstanding any other provision of this article to the
contrary, the sum of the allowances provided as part of the total
basic foundation program for the state for the fiscal year
commencing the first day of July, two thousand three, less the
counties' local share, shall be no greater than the amount
appropriated for the total basic foundation program for the
previous fiscal year. Any of the allowances provided as part of
the total basic foundation program for the fiscal year commencing
the first day of July, two thousand three may be appropriated in an
amount less than that computed by the formulas prescribed elsewhere
in this article. Likewise, the allowance for regional educational
service agencies for the fiscal year commencing the first day of
July two thousand three shall be no greater than the amount
appropriated for such allowance for the previous fiscal year, and
may be appropriated in an amount less than that computed by the
formula prescribed in section eight-a of this article.
NOTE: The purpose of this section is limit the public
education allowances provided as part of the total basic foundation
program for the fiscal year commencing the first day of July, two
thousand three to an amount no greater than that appropriated in
the previous fiscal year. In addition, this section limits the
public education allowance provided for regional educational
service agencies for the fiscal year commencing the first day of July two thousand three to that appropriated for the previous
fiscal year.
